HB 577 allows for individuals to be prescribed use of cannabidiol (CBD) oil in consultation with their medical provider. It also removes the criminal penalties associated with the use of medically approved and physician prescribed CDB oil so long as the individual using the oil is doing so to treat a medical condition, the user has a valid CBD oil registration card, and the CBD oil conforms to state regulations. The ACLU supports the passage of HB 410 for a number of reasons. First, contemporary scientific evidence confirms the therapeutic effects of medical marijuana, including CBD oil, which has provided unique relief for serious conditions when no other medicine is as effective or free of side effects such as nausea or loss of appetite. Nearly one million patients nationwide now use medical marijuana as recommended by their doctors and in accordance with state laws and Idahoans should be able to access the therapeutic effects of CBD oil without fear of prosecution or criminal charges.

Second, this bill recognizes the negative consequences of criminalizing individuals who seek the use of natural treatment options for their serious illness. Idahoans should not have to fear arrest, prosecution and incarceration as they seek medically and scientifically supported treatment options, such as CBD oil.
