Electoral Fairness

 

Before the start of the 2007 Legislative Session, we contacted the Secretary of State’s Office regarding voter pamphlets and constitutional amendments.  Currently, when a proposition or initiative are placed on the ballot, a voter pamphlet sent to all voters includes those initiatives and propositions and also includes pro and con statements for each.  This is not true for constitutional amendment, but we think it should be.  The Secretary of State agreed and introduced HB 207, requiring the Secretary of State to include pro and con statements for proposed constitutional amendments in the voter pamphlet.  HB 207 passed the House floor unanimously and will be debated on the Senate floor soon. 

The ACLU was instrumental in amending 2004 legislation that clarified the process for appeals of election recounts.  Our amendment removed language requiring that the candidate who requested the recount pay everyone’s attorney fees, even if the subsequent recount vindicated the candidate who appealed.
