State v. Stephens

Idaho Falls woman failed to timely mail her juror questionnaire and a magistrate judge ordered her jailed for two days without due process protections (such as notification of right to counsel, right to cross-examine witnesses, etc.)  In March, 2005, after the ACLU appealed the contempt order, the judge acknowledged his error, vacated the order, and directed the county sheriff to expunge her arrest record. 

Boise attorney Tom McCabe served as ACLU of Idaho cooperating counsel.
